Once upon a time a Husband and a Wife went to see a solicitor to make their wills, they both wished to benefit the same person a person whom they both loved and whom they have treated as their son. This person was devoted to them both and behaved much better than their natural son.
On the day that the wills which were in identical terms were signed there was a mix up and they signed the other’s will. Guess what the result was when they died?
Well sadly the wills were held to be invalid as they were not signing what they thought they were signing and there was no will that set out what they wished to take place.
Sadly the devoted ” son” received nothing under the will and took nothing from the Intestacy that resulted in their wills being held to be invalid.
